Welcome to Toursion. These Terms of Service govern your use of our platform and services. By accessing or using Toursion, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing and using Toursion (the "Platform"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

1.1. Platform Purpose

Toursion is a marketplace that connects travelers with local tour operators and guides. We facilitate bookings, payments, and reviews but do not directly operate tours.

1.2. Legal Age

You must be at least 18 years old to create an account and use our services. Minors may use the service only under the supervision of a parent or legal guardian.

2. User Accounts

To access certain features of Toursion, you must register for an account. You agree to provide accurate, current, and complete information during registration.

2.1. Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

2.2. Account Information

You agree to:

  • Provide truthful and accurate information
  • Keep your information updated
  • Not impersonate any person or entity
  • Maintain only one account per person

2.3. Account Suspension

We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activities.

3. Bookings and Payments

Toursion facilitates bookings between travelers and tour operators. All payments are processed securely through our platform.

3.1. Booking Process

When you book a tour, you enter into a direct agreement with the tour operator. Toursion acts as an intermediary to facilitate this transaction.

3.2. Payment Terms

  • Payment is required at the time of booking
  • We accept major credit cards, debit cards, and PayPal
  • All prices are displayed in the selected currency
  • Additional fees may apply for certain payment methods

3.3. Payment Security

All payment information is encrypted and processed through secure payment processors. Toursion does not store your payment details.

3.4. Tour Operator Payments

Tour operators receive payment within 48 hours after tour completion, minus our commission fee. Commission rates vary based on tour type and operator status.

4. Cancellations and Refunds

Our cancellation policy is designed to be fair to both travelers and tour operators.

4.1. Traveler Cancellations

  • Standard Tours: Free cancellation up to 24 hours before tour
  • Premium Tours: Free cancellation up to 48 hours before tour
  • Private Tours: Free cancellation up to 72 hours before tour
  • Late cancellations incur a 50% fee
  • No-shows are non-refundable

4.2. Operator Cancellations

If a tour operator cancels, travelers receive a full refund immediately. Operators may face penalties for late cancellations.

4.3. Refund Processing

Refunds are typically processed within 5-7 business days to the original payment method. Processing times may vary by payment provider.

4.4. Force Majeure

Neither party is liable for failures to perform due to events beyond reasonable control, including natural disasters, government actions, or pandemics.

5. User Conduct

By using Toursion, you agree to conduct yourself in a respectful and lawful manner.

5.1. Prohibited Activities

You may not:

  • Use the platform for illegal activities
  • Harass, abuse, or threaten other users
  • Post false or misleading information
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the platform
  • Spam or send unsolicited communications

5.2. Tour Operator Standards

Tour operators must:

  • Maintain proper licenses and insurance
  • Provide accurate tour descriptions
  • Ensure guest safety during tours
  • Respond to inquiries within 24 hours
  • Maintain a minimum 4.5-star rating

5.3. Review Guidelines

Reviews must be honest and based on actual experiences. Fake reviews, retaliatory reviews, or reviews containing personal information are prohibited.

6. Intellectual Property

All content on Toursion is protected by intellectual property laws.

6.1. Platform Content

Toursion owns all rights to the platform, including software, designs, trademarks, and content. You may not copy, modify, or distribute our content without permission.

6.2. User-Generated Content

By posting content (reviews, photos, comments), you grant Toursion a non-exclusive, worldwide license to use, display, and distribute such content for platform purposes.

6.3. Tour Operator Content

Tour operators retain ownership of their tour descriptions and photos but grant Toursion the right to display this content for marketing and booking purposes.

7. Limitation of Liability

Toursion's liability is limited as described in this section.

7.1. Platform Liability

Toursion is not responsible for the quality, safety, or delivery of tours. We act as a marketplace and do not directly operate tours.

7.2. Damages Limitation

To the maximum extent permitted by law, Toursion's total liability for any claim arising from these terms shall not exceed the amount you paid for the affected tour.

7.3. Excluded Damages

Toursion is not liable for indirect, incidental, special, or consequential damages, including lost profits or data.

Important: We strongly recommend purchasing travel insurance to protect against unexpected events.

8. Termination

These terms continue until terminated by either party.

8.1. User Termination

You may terminate your account at any time by contacting our support team or using the account deletion feature in your settings.

8.2. Platform Termination

We may suspend or terminate your account for:

  • Violation of these terms
  • Fraudulent activities
  • Non-payment of fees
  • Legal requirements

8.3. Effect of Termination

Upon termination, your right to use the platform ceases immediately. We may retain certain information as required by law or for legitimate business purposes.

9. Dispute Resolution

We aim to resolve disputes amicably and efficiently.

9.1. Informal Resolution

Before pursuing formal dispute resolution, please contact our support team. We will work to address your concerns within 30 days.

9.2. Binding Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration under the rules of the American Arbitration Association. Arbitration will be conducted in English and held in San Francisco, California.

9.3. Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration.

9.4. Governing Law

These terms are governed by the laws of the State of California, without regard to conflict of law principles.

10. Changes to Terms

We may update these terms periodically to reflect changes in our practices or for legal and regulatory reasons.

10.1. Notification of Changes

Significant changes will be communicated via email or prominent platform notices. Minor changes may be made without direct notification.

10.2. Effective Date

Updated terms become effective immediately upon posting. Your continued use of the platform constitutes acceptance of the revised terms.

10.3. Review Period

For material changes, we will provide at least 30 days' notice before they take effect, allowing you to review and decide whether to continue using the platform.
